EAA 2026 for Nonprofits and NGOs: Making Your Documents Accessible

The European Accessibility Act (EAA) entered enforcement on June 28, 2026. Most coverage focuses on commercial companies and tech platforms — but nonprofits and NGOs are not exempt.

This affects EU-based nonprofits and foundations, UK charities (subject to UK Accessibility Regulations + Equality Act 2010), US and international NGOs that serve EU constituencies, trade associations and professional bodies with EU membership, and cultural organisations (museums, archives, libraries).

The enforcement threshold matters: organisations with fewer than 10 employees and annual turnover below €2M may qualify for the microenterprise exemption. Most established nonprofits and NGOs do not meet this threshold.

What Documents Are Affected

Annual reports and financial statements
Published online for donors, regulators, and the public. Typically large PDFs that must be usable by people who use screen readers or need to zoom heavily.

Policy papers and research publications
If your organisation publishes advocacy documents or reports that people access to make decisions, these are in scope.

Grant documentation and application guides
If your organisation distributes funding, application guides and forms must be accessible.

Event programmes and conference materials
Conference proceedings, event guides, and printed materials distributed digitally.

The Core Accessibility Requirement Most Nonprofits Miss

Most nonprofits who think about accessibility focus on making documents “screen reader friendly” — adding tags, alt text, and reading order to PDFs. This matters, but it is not enough.

WCAG 2.1 Success Criterion 1.4.10 (Reflow) requires that content can be presented in a single column without horizontal scrolling when displayed at 320px width. This is the requirement that makes documents usable for people with low vision who need to zoom in to 400%.

PDF cannot satisfy WCAG 1.4.10 by design. A fixed-layout PDF — even a perfectly tagged, fully accessible one — cannot reflow. There is no remediation tool, no Acrobat plug-in, and no workflow that changes this. The only solution is conversion to a reflowable format. EPUB3 is the standard for accessible reflowable documents.

Priority 1: Documents currently used to access services
Grant application guides, membership registration forms, current annual reports. These are in active use and should be converted first.

Priority 2: High-traffic documents from the past 2–3 years
Check your analytics. PDFs that receive regular downloads are more likely to be accessed for service purposes.

Priority 3: Archive/historical documents
Documents no longer used to access current services have lower urgency. A statement noting that older documents are available in accessible format on request may be sufficient.
